PRIVACY POLICY

V Family Foundation

V Family Foundation, referred to in this Privacy Policy as the “Foundation,” “we,” “us,” or “our,” is a Massachusetts nonprofit charitable organization recognized as tax exempt under Section 501(c)(3) of the Internal Revenue Code.

The Foundation respects the privacy of individuals who visit our website, make donations, attend Foundation events, communicate with us, or otherwise interact with the Foundation.

This Privacy Policy describes how information may be collected, received, used, disclosed, retained, and protected in connection with www.VFamilyFoundation.com, our charitable activities, fundraising activities, events, communications, and related operations.

By accessing or using www.VFamilyFoundation.com, making a donation, obtaining or purchasing event tickets, communicating with the Foundation, or otherwise interacting with us, you acknowledge the practices described in this Privacy Policy.

1. SCOPE OF THIS PRIVACY POLICY

This Privacy Policy applies to information processed by or on behalf of V Family Foundation in connection with:

  1. www.VFamilyFoundation.com.

  2. Charitable donations made through links provided on the website.

  3. Foundation events.

  4. Communications sent directly to the Foundation.

  5. Information received from service providers used in connection with donations, ticketing, website operation, or Foundation activities.

This Privacy Policy does not govern the independent privacy practices of third party companies or services that you choose to use.

2. INFORMATION COLLECTED THROUGH THE WEBSITE

The Foundation does not currently provide website forms through which visitors submit names, telephone numbers, mailing addresses, medical information, financial hardship information, beneficiary applications, volunteer applications, sponsorship applications, or similar information directly to the Foundation.

The Foundation does not currently operate an email marketing subscription program through the website.

The Foundation does not currently knowingly use Google Analytics, Meta Pixel, or a separate third party advertising analytics platform.

However, Wix and other technical service providers used to operate www.VFamilyFoundation.com may automatically process technical information associated with website access and operation.

Depending upon the technology used by Wix and the visitor's device or browser, such information may include:

  1. Internet Protocol address.

  2. Browser type.

  3. Device type.

  4. Operating system.

  5. Date and time of access.

  6. Referring website information.

  7. Pages viewed.

  8. Website interactions.

  9. Cookies or similar technical identifiers.

  10. Information used for website security, performance, operation, or fraud prevention.

The Foundation does not necessarily receive or independently retain all technical information processed by Wix or other service providers.

3. INFORMATION PROVIDED BY EMAIL

The Foundation may receive personal information when an individual voluntarily contacts us at:

Individuals should not send highly sensitive personal information by ordinary email unless specifically requested and an appropriate method of transmission has been established.

The Foundation does not currently request medical diagnoses, medical records, Social Security numbers, financial account credentials, or similar highly sensitive information through www.VFamilyFoundation.com.

4. CHARITABLE DONATIONS

The Foundation currently provides visitors with the ability to make charitable donations through PayPal.

When you select a donation link, you may leave www.VFamilyFoundation.com and interact directly with PayPal.

PayPal may collect information including:

  1. Name.

  2. Contact information.

  3. Billing information.

  4. Credit card information.

  5. Debit card information.

  6. Bank account information.

  7. Transaction information.

  8. Other information necessary to process the donation.

Payment credentials are processed by PayPal according to PayPal's own terms, privacy policy, security procedures, and data practices.

The Foundation does not currently operate its own payment card processing system through www.VFamilyFoundation.com and does not intend to independently collect or store complete credit card or debit card numbers through the website.

The Foundation may receive information from PayPal concerning a completed donation, such as donor identity, contact information, donation amount, transaction date, transaction status, and other information provided by PayPal to the recipient organization.

That information may be retained as reasonably necessary for charitable, accounting, tax, audit, regulatory, donor acknowledgment, fraud prevention, legal, and organizational purposes.

Tax exempt organizations must maintain records sufficient to document receipts, expenditures, and other information relevant to their federal tax obligations.

5. EVENT TICKETING

The Foundation currently links to Ticketmaster for event ticketing.

When you select a Ticketmaster link, you may leave www.VFamilyFoundation.com and interact directly with Ticketmaster.

Ticketmaster independently controls information collected through its platform according to its own terms and privacy practices.

The Foundation may receive information from Ticketmaster that is reasonably necessary for purposes such as:

  1. Event administration.

  2. Attendance management.

  3. Ticket verification.

  4. Event communications.

  5. Accounting.

  6. Fraud prevention.

  7. Security.

  8. Recordkeeping.

The Foundation does not control Ticketmaster's systems or independent data practices.

6. HOW THE FOUNDATION MAY USE INFORMATION

Information received by the Foundation may be used for legitimate charitable and organizational purposes, including:

  7. Information reasonably necessary for tax, accounting, audit, regulatory, or legal purposes.

Federal tax rules require exempt organizations to maintain books and records sufficient to substantiate their activities, receipts, and expenditures.

Nothing on www.VFamilyFoundation.com constitutes tax, legal, financial, or accounting advice.

Donors are responsible for consulting their own professional advisers regarding the deductibility or tax treatment of contributions.

8. COOKIES AND WEBSITE TECHNOLOGY

Wix and technologies used to operate www.VFamilyFoundation.com may use cookies or similar technologies necessary for website operation, security, performance, functionality, or related technical purposes.

The Foundation does not currently knowingly operate a separate advertising tracking program or behavioral advertising platform through the website.

Visitors may be able to manage cookies through their browser or device settings.

Restricting certain cookies may interfere with website functionality.

9. WIX

www.VFamilyFoundation.com is created and hosted using Wix technology.

Wix may process technical and other information as necessary to provide services including:

  1. Website hosting.

  2. Security.

  3. Content delivery.

  4. Website functionality.

  5. Infrastructure.

  6. Performance monitoring.

  7. Technical support.

  8. Cookies and similar technologies.

Wix is an independent service provider and maintains its own privacy policies, contractual terms, security procedures, and technical practices.

The Foundation does not control every component of Wix's infrastructure or data processing activities.

The Foundation may disclose information where reasonably necessary to:

The Foundation may also disclose information where reasonably necessary to protect persons, property, Foundation assets, charitable assets, legal rights, or the integrity of Foundation operations.

11. NO SALE OF PERSONAL INFORMATION

V Family Foundation is a charitable organization and does not operate as a commercial data broker.

The Foundation does not currently sell donor or website visitor personal information for monetary compensation.

Some privacy statutes define terms such as “sale,” “sharing,” or similar concepts differently from their ordinary meaning.

Nothing in this Privacy Policy constitutes an admission that any particular privacy statute applies to the Foundation.

The Foundation expressly reserves every exemption, exclusion, defense, and limitation available to nonprofit organizations under applicable law.

12. PRIVACY RIGHTS AND LEGAL REQUESTS

Privacy rights vary based upon:

  1. The law involved.

  2. The individual's state or country.

  3. The type of information involved.

  4. The Foundation's relationship with the individual.

  5. Whether a particular law applies to a nonprofit charitable organization.

Where applicable law provides a legally enforceable right, the Foundation will respond as required by that law.

Such rights may, depending upon applicable law, concern:

  3. Deletion.

  4. Copies of certain information.

  5. Restrictions on processing.

The Foundation may retain information notwithstanding a request for deletion where retention is permitted or required for purposes including:

  5. Fraud prevention.

  6. Security.

  7. Litigation.

  8. Insurance.

  9. Regulatory compliance.

  10. Legal obligations.

  11. Establishing or defending legal claims.

Nothing in this Privacy Policy voluntarily subjects V Family Foundation to a statute or regulatory regime that would not otherwise apply.

13. INFORMATION CONCERNING CHILDREN

www.VFamilyFoundation.com is intended for a general audience.

The Foundation does not currently use the website to solicit personal information from children under 13.

Although the Foundation's charitable mission may involve families affected by rare diseases or special needs, the website does not currently provide a mechanism through which families submit medical records, diagnoses, children's applications, beneficiary applications, or similar sensitive information.

If that practice changes, this Privacy Policy should be revised before such information is collected.

14. EVENT PHOTOGRAPHY AND VIDEO

Foundation events may be photographed, filmed, or otherwise recorded.

Images or recordings from Foundation events may subsequently appear on:

  1. www.VFamilyFoundation.com.

  2. The Foundation's Instagram account.

  3. Foundation social media.

  4. Foundation promotional materials.

  5. Fundraising materials.

  6. Foundation publications.

  7. Other Foundation communications.

The Foundation may use photographs or recordings for legitimate charitable, educational, archival, informational, fundraising, promotional, and community outreach purposes, subject to applicable law and any separate release requirements.

This Privacy Policy does not replace an event photography or publicity release where a separate release is legally advisable or required.

Individuals who have specific concerns regarding photographs or recordings should contact the Foundation at Info@VFamilyFoundation.com.

For maximum protection, I would also place a photography and recording notice directly on your event ticket terms and at the event entrance rather than relying exclusively on the Privacy Policy.

15. INFORMATION SECURITY

The Foundation seeks to maintain reasonable administrative, technical, organizational, and physical safeguards appropriate to information under its control.

No website, computer, network, server, email system, payment service, ticketing service, database, or electronic communication method can be guaranteed to be completely secure.

The Foundation therefore cannot warrant or guarantee absolute security.

Massachusetts maintains data security and breach notification requirements applicable to organizations possessing specified personal information concerning Massachusetts residents. Covered incidents can trigger notification obligations to affected residents, the Massachusetts Attorney General, and the Office of Consumer Affairs and Business Regulation.

The Foundation will address security incidents in accordance with applicable law and the circumstances of the incident.

16. SECURITY INCIDENTS AND BREACH NOTIFICATION

If the Foundation knows or has reason to know of a security incident affecting information for which notification is required by applicable law, the Foundation will take such actions as legally required.

Massachusetts law generally requires covered organizations to provide notice as soon as practicable and without unreasonable delay when specified personal information concerning a Massachusetts resident is involved in a qualifying breach or unauthorized acquisition or use.

Depending upon the circumstances, legally required notification may include notification to:

  1. Affected individuals.

  2. The Massachusetts Attorney General.

  3. The Massachusetts Office of Consumer Affairs and Business Regulation.

  4. Other governmental or regulatory authorities.

Nothing in this Privacy Policy creates a contractual right to notice, compensation, credit monitoring, reimbursement, or another remedy beyond what applicable law requires.

17. DATA RETENTION

The Foundation may retain information for as long as reasonably necessary to fulfill the purposes for which it was obtained or legitimate charitable and organizational purposes.

Retention considerations may include:

  1. Federal tax requirements.

  2. Massachusetts charitable organization requirements.

  3. Accounting.

  4. Auditing.

  5. Donation records.

The Foundation may publish photographs, videos, information, and other materials through Instagram and other social media services.

Social media platforms operate independently from V Family Foundation.

Information collected by Instagram or another social media company is governed by that company's own terms and privacy practices.

The Foundation is not responsible for independent privacy, security, or data processing decisions made by a social media provider, except to the extent applicable law provides otherwise.

19. THIRD PARTY LINKS

www.VFamilyFoundation.com may contain links to independent websites and services, including:

  1. PayPal.

  2. Ticketmaster.

  3. Instagram.

  4. Sponsors.

  5. Event venues.

  6. Event vendors.

  7. Other organizations or services.

The presence of a link does not mean the Foundation controls, guarantees, endorses, or assumes responsibility for the privacy practices, security, content, products, services, or operations of that third party.

Once a visitor leaves www.VFamilyFoundation.com, the visitor should review the privacy policies and terms of the applicable third party.

20. LEGAL PROCESS AND PROTECTION OF RIGHTS

The Foundation may preserve, access, process, or disclose information where it reasonably believes doing so is appropriate to:

  1. Comply with applicable law.

  2. Respond to lawful legal process.

  3. Respond to subpoenas.

  4. Respond to court orders.

  5. Respond to governmental inquiries.

  6. Cooperate with law enforcement.

  12. Protect donors, attendees, volunteers, directors, officers, employees, beneficiaries, or service providers.

  15. Defend legal claims.

  16. Enforce agreements or Foundation policies.

Nothing in this provision requires the Foundation to disclose information where the Foundation has a lawful basis to object to, limit, challenge, or resist a request.

21. ORGANIZATIONAL CHANGES

If the Foundation undergoes a merger, consolidation, restructuring, dissolution, transfer of assets, affiliation, combination with another charitable organization, or similar organizational change, information held by the Foundation may be transferred, preserved, archived, or otherwise handled as reasonably appropriate in connection with that transaction and applicable law.

22. INTERNATIONAL VISITORS

V Family Foundation is based in Massachusetts, United States.

Individuals accessing www.VFamilyFoundation.com outside the United States acknowledge that information processed through third party service providers may be processed or stored in the United States or other jurisdictions.

Nothing in this provision waives rights that cannot legally be waived.

23. NO CONTRACTUAL GUARANTEE

This Privacy Policy describes the Foundation's privacy practices.

Except to the extent applicable law expressly provides otherwise, this Privacy Policy is not intended to establish independent contractual warranties, guarantees, fiduciary relationships, or obligations beyond those imposed by law.

24. RESERVATION OF RIGHTS

Nothing contained in this Privacy Policy shall be construed as:

  1. An admission that a particular federal, state, local, or international privacy statute applies to the Foundation.

  2. A voluntary waiver of a statutory exemption applicable to a nonprofit or charitable organization.

  3. A waiver of any defense.

  4. A waiver of any privilege.

  5. A waiver of any immunity.

  6. A waiver of any limitation of liability.

  7. A waiver of any legal remedy.

  8. A waiver of any right to challenge jurisdiction, venue, standing, causation, damages, or another element of a claim.

  9. An expansion of a legal obligation beyond what applicable law requires.

The Foundation expressly reserves all rights, defenses, exemptions, privileges, immunities, protections, and remedies available under applicable law.

25. CHANGES TO THIS PRIVACY POLICY

The Foundation may amend this Privacy Policy from time to time to account for changes involving:

  2. Website functionality.

  3. Donation services.

  4. Ticketing services.

  5. Service providers.

  6. Technology.

  7. Information practices.
